TERMS & CONDITIONS
1. General Agreement
By registering as a member, purchasing any package or add-on, or accessing Nast Fitness facilities, you agree to be legally bound by these Terms and Conditions. These Terms govern all memberships, payments, and use of our premises and services.
Nast Fitness reserves the right to modify these Terms at any time. Updated versions will be posted at https://nastfitness.com/terms, and continued use of our services constitutes acceptance of those updates.
2. Membership Terms
2.1 Membership Classification
All Nast Fitness memberships are non-contractual by default, unless otherwise explicitly stipulated in writing.
Nast Fitness may, at its discretion, offer corporate or group memberships under fixed-term contracts, which will specify duration, renewal, and termination terms separately in the agreement.
Individual consumer memberships remain month-to-month and automatically renew unless cancelled in accordance with Section 4.
2.2 Eligibility
Memberships are open to individuals aged 12 years and above.
Members aged 12–17 years old must have a parent or legal guardian’s signed consent and presence at registration. Minors may be required to train under supervision during designated hours or in accordance with Nast Fitness’s safety policy.
2.3 Non-Transferability
Memberships, access cards, and all related privileges are personal and non-transferable. Lending or sharing of access credentials will result in immediate suspension or termination.
3. Payments and Billing
3.1 Automatic Recurring Payments
By providing your payment information, you expressly authorize Nast Fitness and its payment processor (PayMongo) to automatically charge your stored payment method for membership fees and any selected add-ons at the start of each renewal period, until proper cancellation is received.
By agreeing to recurring payments, the cardholder authorizes PayMongo to automatically deduct payment from the given credit/debit card account until he/she revokes such authorization. The payments shall be charged at the start of each billing cycle, which shall be dependent on the agreed products/plans. After the processing of payment, the Merchant shall reach out to the cardholder if his/her payment is successful or not. PayMongo shall not be held liable for the Merchant's failure to notify the cardholder regarding the payment status. The cardholder further acknowledges and agrees that the billing cycle and amount to be deducted are dependent on the instructions made by the Merchant to PayMongo.
3.2 Authorization and Responsibility
Under penalty of law, you affirm that the card on file belongs to you, the account holder. Unauthorized use of another individual’s card or payment method constitutes fraud and will result in immediate membership termination and potential legal action.
3.3 Failed or Declined Payments
If your payment is declined, Nast Fitness may attempt reprocessing or suspend facility access until the balance is cleared. Repeated failed payments may result in account termination.
3.4 Refund Policy
All membership and add-on payments are non-refundable once billed, including cases of non-attendance or early termination.
4. Cancellation Policy
- Members must provide at least fifteen (15) days’ written or emailed notice prior to the next billing date to cancel a membership.
- Notice may be submitted at the front desk or emailed to support@nastfitness.com.
- Cancellations received with less than 15 days’ notice will result in one additional billing cycle. The account will terminate at the end of that cycle.
- No refunds or pro-rated credits will be issued for unused days within a paid term.
5. Facility Rules and Conduct
- Members must follow all posted gym rules, staff instructions, and safety guidelines.
- Proper attire, footwear, and hygiene are required at all times.
- Equipment must be wiped and re-racked after use.
- Harassment, disorderly conduct, or damage to property will result in immediate suspension or termination without refund.
- Nast Fitness reserves the right to refuse entry to anyone who poses a risk to the safety, cleanliness, or atmosphere of the facility.
6. Health and Liability
Members certify that they are in good physical condition and have consulted a physician prior to participating in physical activities.
Nast Fitness, its owners, and staff shall not be liable for injuries, health complications, or accidents arising from facility use or participation in any activity.
By entering the premises, members assume all risks associated with exercise and facility use.
7. Personal Belongings
Nast Fitness is not responsible for loss, theft, or damage to personal items left unattended in the facility, lockers, or parking areas. Members are encouraged to secure valuables and bring only necessary items.
8. Data Privacy and Security
All personal and payment information is processed in compliance with the Philippine Data Privacy Act of 2012 (R.A. 10173).
Your information will be used solely for legitimate business purposes, including billing, communication, and service improvement.
We do not sell or disclose your data to third parties except for payment processing and operational requirements.
9. Suspension and Termination
Nast Fitness may suspend or terminate memberships for:
- Violation of these Terms
- Misconduct or safety risk
- Non-payment or chargeback disputes
- Fraudulent or false information
Suspension or termination does not exempt the member from paying any outstanding balance.
10. Service Modifications
Nast Fitness reserves the right to modify operating hours, class schedules, pricing, and facility features at any time, with notice posted on-site or online.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising hereunder shall be resolved exclusively in the proper courts of Lapu-Lapu City, Cebu.
